Usama is extorting Trenk, Spitzer, Durkin and Monachino—Usama either wants his job back, or $3 Million claiming breach of contract and bad faith in a Notice of Claim filed September 18, 2013. Usama’s claims are mostly fluff- $1 Million for “emotional distress,” $1 Million for “punitive damages,” and ~$800,000 for lost wages from a future pension. Usama has a duty to mitigate damages. He could have taken $140,000 severance and found another job even if was flippin’ burgers at McDonald’s. Instead, he’s $16,000 south for attorney fees, not to mention the $39,000 in attorney fees to Mariscal Weeks. That’s an interesting conflict of interest. How does Mariscal Weeks represent the council members from Usama when Mariscal Weeks used to represent Usama? Then there is the matter of the cost of putting a water tank on someone’s property. Should be Usama’s expense- not the Town. That’s $800,000 to $1.2 Million. Apparently Usama is as incompetent at managing his household as he was managing the Town.
Usama’s lawsuit is a ruse to see if the new council members will cave to the bully tactics promulgated by Sorchych propaganda, just like his printing of the “neighborhood Swastika.” Don uses fear to get his way, and printing articles about Usama’s meritless lawsuit is intended to scare the new council members.
Case law in Arizona is clear: “At-will” employment contracts are unilateral. An “At-will” contract can be terminated at any time for good cause or no cause at the will of either party. At-will employment contracts are unilateral and typically start with an employer’s offer of a wage in exchange for work performed; subsequent performance by the employee provides consideration to create the contract.
Usama’s got nothing. Actually, he’s got less than nothing. On Monday night, Council was apprised of a $39,000 bill run up by Usama with Mariscal Weeks to cover his screw ups with the water tank and other malfeasance.
Usama was misappropriating the Town’s money to pay for his mistakes at the rate of $2,500 a month. Since the Town was opaque under Usama, these payments would get lost in the shuffle. Our new manager indicated that he negotiated this item down to $25,000 with Mariscal Weeks. What the Truth wants to know is why is the Town liable for this bill and why would Council rehire Mariscal Weeks when they clearly compromised their ethics?
The “Out to Lunch Bunch” of incumbent council members played dumb and dumber knowing nothing about it. Really? Civics 101: The Citizens of Cave Creek elect the Council. The Council is the client of Mariscal Weeks—not the Town Manager. If the Town Manager is asking Mariscal Weeks to clean up his screw ups, Mariscal Weeks has a duty to inform their client—the Town Council.
So why would Trenk fawn so lovingly over Mariscal Weeks? Because it’s good for his political career. At least his motivation is transparent.
Trenk and Steve LaMar are both lawyers and share personality traits. They both claim to be horsemen. Prince Charles is a horseman. Being a horseman has nothing to do with Cave Creek being a western town. Cave Creek considers itself a throw back to a by-gone era of the Wild West, but like Scottsdale, Cave Creek is confused about its orientation.
How many working ranches are there in Cave Creek? All this talk about being a horse oriented community may play well with those who long to live in the past, but LaMar is correct—Cave Creek is filled with posers. But the biggest poser is Sorchych—the rabid watchdog. Don bitches about Town Council agenda as if the new council members have a say in the agenda. The Mayor sets the agenda. Any lack of transparency is due to the Buddhist Bookie who probably launders money at the race track. Sorchych claims to be a champion of citizen’s rights when in fact, he’s a socialist. He freeloaded off of Freeman, then tried to get the Town to pay for his driveway maintenance. Now he’s up and arms over Glassman’s initiative to implement grey water and solar.
Glassman needs to rethink his priorities. The highest and best use of his time is to construct a list of lawsuits and malfeasance caused by Abujbarah. But this would require Glassman to look into the past and get his hands dirty.
Candidly, this is what we thought Glassman was hired to do, and why we supported Trenk’s recommendation to appoint Glassman interim town manager.
Dig deep. Find the screw ups. How much did it really cost Cave Creek to have Usama be the Town Manager? Get a real audit. Assess the town staff. Get rid of the bad apples, Ian Cordwell being the worst followed by Stein and Anderson.
A PhD knows how to do research. How many towns are there in the United States with a population of 3,500 to 5,000? What are their operating budgets? How much do they pay their town manager? Zoning Administrator? Marshal? Engineer? What is appropriate staffing for town of this size? What does their organizational chart look like?

To Cave Creek Town Council:
The City of Scottsdale has ownership of the United States trademark “The West’s Most Western Town” -registration #7664642 | 7/17/2007. In the final analysis, the use of this mark by the Town of Cave Creek is inviting at a minimum an embarrassing cease and desist or the potential for expensive litigation.
In my opinion, the town government should be focused on governing and leave the marketing initiatives to the local chamber of commerce or event organizers.
