On June 1, 2015, Gary Birnbaum stated: “Under Arizona Statues public notice has to be given in newspapers that meet certain statutory criteria. Our analysis is that the Sonoran News does not meet that criteria. So, the motion as stated does not comport with Arizona Law. Having said that, and I was not at your last meeting, my understanding is that the proposal that has been made to the Sonoran News is that public notices that have been presented for publication would be published in the Gila Bend newspaper and then apparently also published in the Sonoran News. As stated, Councilwoman Clancy as I understand it is proposing that public notice be placed in the Sonoran News as comporting with Arizona law, the Town attorney disagrees with that. That can not be done.”
Ethical Creekers have been claiming this for over a decade. It’s one of the reasons why the “Good Guy Council” switched to the Arizona Republic last session.
We’re calling Gary a liar because he let it slide all these years when his law firm was our attorney and said nothing, did nothing, just smiled and acquiesced and the Town broke the law making the S’Nooze the Town’s official newspaper. If the Sonoran News does not comply with Arizona law now, it didn’t sixteen years ago. In other words, Gary lied to us for over a decade. He and his law firm engaged in a pattern of racketeering in concert with Sorchych, our Buddhist Bookie for a Mayor and Zombie Council members like Bunch, Esser, McGuire, and LaMar. The citizens of Cave Creek sustained reasonable and foreseeable injury at the hands of these sociopaths.
Birnbaum is now in “lame duck” mode, and claims that he’s waited 16 years to blast Sorchych. Thanks for clearing your conscience Gary. Let’s not forget that Gary’s “ethical” business mentor was the seriously twisted Charlie Keating.
Therein lies the crux of the problem in Cave Creek—Keating-style situational ethics. Town employees, elected officials, even its attorneys will do, and rule to the benefit of the situation, not according to principles of law or higher moral values. Cave Creek places a priority on corruption over ethical conduct, or even lawful conduct.
Leading the charge, Sims and Murray will be the town’s new attorneys. Sims Murray represents AMRRP, the Town’s insurance carrier. Anybody see any “huge” conflict of interest here? Nah. Donny Boy likes the “Fat Bastard” Murray. It’s just business as usual, the Junta at work. Consider Cave Creek hiring Fat Bastard Murray as vertical integration of the racketeering, like a drug cartel. Grow the poppies, process it into heroin, transport it to the US, and sell it on the street. Fat Bastard Murray will “grow” the wrongful conduct of the Town and then defend the Town against its citizen’s lawsuits (i.e. process it into heroin). No need for transport. Murray makes money coming and going all at our expense. That’s a racket, just like heroin. Only Fat Bastard Murray wears a white collar.
Pathetic, or more succinctly apathetic, as all the narcissists in Cave Creek let it happen.
Meanwhile Donny is dancing on his deathbed. He and his lemmings think they’re winning but they’re hanging themselves. Don is old, and pretty sick, but his troops are really stupid, saying things like “They told us to vote that way.”
